KAIZER Booking Back to the site

Terms of Service

Updated 26 September 2026

These Terms of Service (the “Terms”) are provided by Kaizer Inc. and its affiliates (the “Company”, “we”, “our” or “us”). They apply to your access to and use of (1) our websites at kaizerbooking.com and app.kaizerbooking.com, with all subordinate pages and salon booking pages, (2) the KAIZER Booking web application, including its installation on a phone or tablet home screen, and (3) the related online services (together, the “Services”).

These Terms are written for the Subscriber — the salon, studio, barbershop or independent professional that opens an account — and for every person the Subscriber lets into that account. If you are a client of a salon and only book, sign forms or pay through a salon’s page, the short Terms for salon clients apply to you as well; where they conflict with these Terms, the client terms prevail for you.

You and the Company agree to resolve most disputes exclusively through individual arbitration, not through class or representative proceedings and not before a jury. If you do not want to arbitrate, you may opt out as described in Section 12(h). If you do not agree to these Terms, you may not use or purchase the Services.

How we collect, use and share information about you and about your clients is described in our Privacy Policy, Security page and GDPR page. Payments, messaging and accounting connections are provided by third parties under their own terms (Section 5).

We may change these Terms from time to time. When we do, we update the date at the top; for material changes we also notify the Subscriber inside the program (“What’s new”) or by e-mail. Unless the notice says otherwise, the changes take effect immediately, and continued use of the Services after the notice is acceptance of the changes. If you do not agree, stop using the Services and cancel the subscription.

1. Eligibility and accounts

(a) Age. You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract to open an account.

(b) Business use. The Services are a tool for businesses. By opening an account you confirm that you use the Services for your salon or professional practice and not as a consumer.

(c) Where the Services may be used. The Company is based in the United States and offers the Services worldwide, except in countries under a United States embargo or to persons on a United States denied-persons list. You represent that neither applies to you. Some functions (card payments, SMS from your phone, accounting connections) depend on third-party providers that may not be available in your country.

(d) Your account. The account is opened with a working e-mail address and belongs to the Subscriber, not to any single employee. You are responsible for everything done under your account and under the staff logins you create, for keeping passwords secret and for choosing who receives which access rights. Use a strong password that you do not use elsewhere and tell us immediately at support@kaizerbooking.com if you suspect that someone has entered your account without permission. We may reclaim account names and salon addresses that infringe someone’s rights or that were chosen to mislead.

(e) Accuracy. Keep the business details, contact e-mail and payment method in your account current. Notices sent to the e-mail on file are deemed delivered.

2. Subscription, trial and payment

(a) Plans. The features of each plan and the current prices are shown on the Pricing page and in the program under Settings → Subscription. The plan you choose determines which features are available.

(b) Trial. A new account starts with a free trial during which every feature is available. No card is required to start. When the trial ends, the account continues only after a plan is paid for; the data remains available for export.

(c) Billing. Subscriptions are billed in advance for each billing period (monthly or yearly) and renew automatically for the same period until cancelled. By providing a payment method you authorise us and our payment processor to charge the subscription fee and any applicable taxes at each renewal. Card payments are processed by Stripe; we never see your full card number.

(d) Cancellation and refunds. You may cancel at any time in Settings → Subscription. Cancellation stops the next charge; the period already paid for stays available until its end. Except where the law requires otherwise, fees are not refunded for unused time. If a charge fails, we will notify you and may suspend the account until payment is made.

(e) Price changes. We may change prices. We give notice inside the program or by e-mail at least 30 days before a new price applies to your next renewal. If you do not accept the new price, cancel before that renewal.

(f) Taxes. Prices exclude sales tax, VAT and similar taxes; where we are required to collect them, they are added to the invoice.

(g) Payments you take from your clients. Deposits, card payments, memberships and tips that your clients pay go to your own Stripe or Square account under your agreement with that provider. We do not hold your clients’ money and do not charge a commission on it; the provider’s processing fees apply.

3. Your content and your clients’ data

(a) Ownership. Everything you and your staff enter into the Services — client cards, appointments, photos, notes, forms, prices, messages, documents, stock, sales and accounting records (“Subscriber Content”) — belongs to you. The personal data of your clients belongs to your business; we process it only on your instructions, as your processor, as described in the Privacy Policy and the GDPR page.

(b) Licence to us. So that the Services can work, you grant the Company a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, display and back up Subscriber Content and to create the derived data needed to run the Services (reports, reminders, search indexes, backups). We do not sell Subscriber Content, do not use it to advertise to your clients and do not show it to other subscribers. The licence ends when the content is deleted from the Services and from backups under the schedule in Section 13.

(c) Your responsibility for the content. You are responsible for having the right to enter Subscriber Content into the Services and for complying with the laws that apply to it: obtaining your clients’ consent to store their data and to receive reminders and marketing where the law requires it, honouring unsubscribe requests, keeping health information confidential and giving clients access to their data when they ask.

(d) Prohibited content. You may not enter, upload or send through the Services content that (i) is unlawful, defamatory, obscene, harassing, threatening or invades someone’s privacy; (ii) infringes a copyright, trademark, trade secret or other right; (iii) contains personal data of a third party that you have no right to process; (iv) contains viruses or other harmful code; (v) is spam, chain mail or an unsolicited commercial message; or (vi) impersonates a person or organisation.

(e) Our remedies. We have no obligation to monitor Subscriber Content, but we may remove content or suspend an account that in our reasonable judgement violates these Terms or the law, with notice where practicable, and we will cooperate with lawful requests from authorities.

(f) Export. You may export your data at any time: the client base and every other table as Excel/CSV, and the whole account as one ZIP archive from Settings → Security → Your data. The export is available during the subscription and for 30 days after the account is closed.

4. Acceptable use

You will use the Services only for their intended purpose and in compliance with these Terms and the law. In addition, you will not:

5. Third-party services

The Services connect to services of other companies that you choose to enable: Stripe and Square (card payments, terminals, subscriptions), QuickBooks and bank feeds (accounting), Google Calendar (calendar sync), Meta (advertising events), e-mail delivery providers, and your own phone for SMS and WhatsApp. Each of these is governed by that provider’s own terms and privacy policy, and your relationship with the provider is directly with the provider. We are not responsible for their availability, fees, decisions (for example, a payment hold) or changes to their interfaces, although we will try to keep the connections working and will tell you if a connection stops being supported.

SMS and WhatsApp messages are sent from the Subscriber’s own phone number; the Services only prepare the message. The Subscriber is the sender of these messages and is responsible for their content and for the consent of the recipients.

6. Promotions

Coupons, memberships, gift offers, contests and other promotions that you run through the Services are your promotions, governed by your own rules and by the laws that apply to you. Promotions that we run are governed by the rules we publish for them; where those rules conflict with these Terms, the promotion rules prevail for that promotion.

7. Intellectual property

(a) Ownership. The Services, including their software, design, text, graphics, templates, page styles, documentation and all intellectual-property rights in them, belong to the Company or its licensors and are protected by United States and international law. Except for the rights expressly granted in these Terms, all rights in the Services are reserved.

(b) Limited licence. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Services for your business during your subscription, including installing the web application on the devices you control. The Services are licensed, not sold. Any use beyond this licence without our written permission ends the licence and infringes our rights.

(c) Feedback. If you send us questions, comments, ideas or suggestions about the Services (“Feedback”), you agree that we may use the Feedback for any purpose without obligation, credit or compensation to you.

(d) Trademarks. “KAIZER Booking”, the KAIZER logo and the names of our products and page styles are marks of the Company and may not be copied, imitated or used without our prior written permission, except for the “Powered by Kaizer Booking” line that the Services place on booking pages under the plan rules. Other marks mentioned in the Services belong to their owners; a reference to them does not imply endorsement.

8. Copyright complaints

(a) Repeat infringers. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable law, we terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the intellectual-property rights of others.

(b) Notice of infringement. If you believe that content in the Services infringes your copyright, send a notice that meets the requirements of 17 U.S.C. § 512(c)(3) to our designated agent:

A notice that does not meet the statutory requirements may not be effective. Knowingly misrepresenting that material infringes a copyright can make you liable for costs and damages.

9. Indemnification

To the fullest extent permitted by law, you will indemnify, defend and hold harmless the Company and its affiliates, officers, directors, employees, agents and partners (the “Company Parties”) from any losses, liabilities, claims, demands, damages, costs and expenses, including reasonable attorneys’ fees, arising out of or related to (a) your access to or use of the Services; (b) Subscriber Content; (c) your breach of these Terms or of the law, including the laws on personal data and on commercial messaging; (d) your dealings with your clients, staff and third-party providers; or (e) a dispute between you and a client of your salon. You will notify us promptly of such claims, cooperate in the defence and pay the costs of defence. The Company Parties may take over the defence and settlement of a claim; you will not settle a claim that imposes an obligation on a Company Party without our written consent.

10. Disclaimer of warranties

Your use of the Services and of any content or material provided through them is at your own risk. Except as expressly stated by us in writing and to the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure or that any content, report, calculation or reminder will be accurate, complete or timely. Reports and analytics are aids to your decisions, not accounting, tax or legal advice. The Company is not responsible for the services or conduct of third-party providers or of the clients of your salon. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

11. Limitation of liability

(a) To the fullest extent permitted by law, the Company Parties are not liable to you under any theory of liability — contract, tort (including negligence), strict liability, warranty or otherwise — for any indirect, consequential, exemplary, incidental, punitive or special damages or for lost profits, lost revenue, lost data or business interruption, even if a Company Party has been advised of the possibility of such damages.

(b) The total liability of the Company Parties for all claims arising out of or relating to these Terms or the Services, regardless of the form of action, is limited to the greater of one hundred U.S. dollars (US $100) or the amount you paid us for the specific Service that gave rise to the claim.

(c) The limitations in this Section do not exclude or limit liability for gross negligence, fraud or wilful misconduct of the Company Parties, or any liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you.

(d) To the fullest extent permitted by law, you release the Company Parties from liabilities, claims and damages, known or unknown, arising out of disputes between you and your clients, your staff or third-party providers, and out of the acts or omissions of third parties.

12. Dispute resolution; binding arbitration

Please read this Section carefully. It requires you and the Company to arbitrate certain disputes on an individual basis and limits the ways in which you can seek relief. Arbitration means that neither party can bring a claim in court or before a jury. Class actions, class arbitrations and representative proceedings are excluded. You and the Company waive the right to a jury trial.

(a) Claims covered. This Section applies to every dispute, claim or controversy between you and the Company, whether based on contract, tort, statute, fraud, misrepresentation or any other legal theory, that arises out of or relates to these Terms or the Services, including claims about privacy or data security and claims about the validity, enforceability or scope of this Section (“Claims”), except the Claims listed in Section 12(c).

(b) Informal resolution first. Before starting arbitration, you and the Company will try to resolve the Claim informally for 45 days after one party receives written notice of the Claim from the other (the “Claimant Notice”). Send your notice to Kaizer Inc., Attn: Legal, New York, NY, USA (registered address is provided on request), or by e-mail to support@kaizerbooking.com; we will send ours to the e-mail on your account. The notice must include the name, address, e-mail and phone of the claimant, a description of the Claim and the facts it is based on, the specific relief sought, and a personal signature of the claimant (not only of counsel). An arbitration demand filed before the informal period ends may be dismissed or stayed by the arbitrator, and the applicable statutes of limitation are tolled during the informal period.

(c) Exceptions. Either party may bring (i) an individual action in small-claims court, and (ii) a court action seeking an injunction or other equitable relief for the actual or threatened infringement or misuse of intellectual-property rights. Nothing in this Section prevents you from reporting a matter to a government agency.

(d) Arbitration rules and forum. Any Claim not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules (or, if you are treated as a consumer under applicable law, its Consumer Arbitration Rules), as modified by this Section. The rules are available at adr.org. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this Section. The arbitrator, and not a court, decides all procedural and substantive questions, including whether a Claim is arbitrable, and may award only relief that is individual to the party seeking it.

(e) Procedure. The arbitration will be conducted by a single arbitrator in the English language. For Claims under US $10,000 the arbitrator decides on the documents unless a hearing is needed; otherwise hearings are held by video or telephone unless the arbitrator finds an in-person hearing necessary, in which case it takes place in New York, New York. The arbitrator will issue a reasoned written decision, and judgment on the award may be entered in any court of competent jurisdiction. Fees are allocated under the applicable AAA rules; if the arbitrator finds a Claim frivolous or brought for an improper purpose, the arbitrator may award the other party its costs and attorneys’ fees to the extent permitted by law. The parties will keep confidential information, trade secrets and materials exchanged in the arbitration confidential.

(f) Mass arbitration. If 25 or more Claimant Notices with similar Claims and the same or coordinated counsel are received, they will be treated as a “mass arbitration”. The parties will select an initial set of 20 Claims (10 chosen by each side) to be filed and decided first; the remaining Claims are not filed and no fees for them are due until then. After the initial set is decided, the parties will mediate the remaining Claims within 30 days; if 100 or more remain unresolved after mediation, either side may opt the remaining Claims out of arbitration, in which case they proceed in court under Section 15(b), with class treatment limited to the claimants in the mass arbitration. Otherwise, the AAA selects a further batch of 30 Claims and the process repeats until all Claims are resolved.

(g) Class-action waiver. You and the Company agree that each may bring Claims only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated or representative proceeding. If this waiver is found unenforceable for a particular Claim, that Claim will proceed in court under Section 15(b), and the rest of this Section stays in effect.

(h) Opt-out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by sending an e-mail to support@kaizerbooking.com with the subject “Arbitration opt-out”, stating your full name, salon name, account e-mail and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.

(i) Changes to this Section. You may reject changes we make to this Section (other than to notice addresses) by e-mailing us within 30 days after the change with your full name, account e-mail and a clear statement of rejection; the last version you accepted then continues to apply. A rejection must cover the whole Section, not parts of it.

(j) Time limit. To the extent permitted by law, a Claim must be brought within two years after it arises, or it is permanently barred.

(k) Severability of this Section. If any part of this Section is found invalid or unenforceable, that part is severed; the rest of the Section remains in force, except that if the class-action waiver is unenforceable for a Claim, that Claim proceeds in court as stated in Section 12(g).

13. Suspension, termination and data after the end

(a) By you. You may stop using the Services and close the account at any time in Settings → Security → Your data → Delete the account, or by cancelling the subscription and letting it expire.

(b) By us. We may suspend or terminate your access to all or part of the Services, with notice where practicable, if the subscription is unpaid, if you breach these Terms or the law, if a third-party provider or an authority requires it, or if continued service would expose the Company to liability. We may also discontinue or change the Services or any feature; we will give reasonable notice of a discontinuation of the Services as a whole.

(c) Your data afterwards. After the account is closed or the subscription ends, the account is locked; Subscriber Content stays available for export for 30 days and is then deleted from the Services and from backups under the backup retention schedule (30 days). During those 30 days you can ask us to restore the account. After deletion the data cannot be recovered.

(d) Survival. Sections 3(b) (for backups), 7, 9, 10, 11, 12, 13(c) and 15 survive termination.

14. Changes to the Services

We develop the Services continuously and may add, change or remove features, plans and integrations. Material changes are announced under “What’s new” inside the program. We are not liable for any loss caused by a change to or discontinuation of a feature, but where a paid feature is removed during a paid period we will offer a proportional refund or an equivalent feature.

15. General

(a) Governing law. These Terms and any Claim are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law rules. If your local law requires that consumer contracts be governed by the law of your place of residence, this Section applies only to the extent it does not conflict with that law.

(b) Venue. Any Claim that is not subject to arbitration under Section 12 and cannot be brought in small-claims court will be brought exclusively in the state or federal courts located in New York County, New York, and you and the Company consent to the personal jurisdiction of those courts.

(c) Severability. Except as provided in Section 12(k), if a provision of these Terms is found invalid or unenforceable, it is severed, and the remaining provisions continue in full force; the invalid provision is modified to the minimum extent needed to make it enforceable.

(d) Entire agreement; waiver. These Terms, with the Privacy Policy, the Terms for salon clients and any plan-specific terms we publish, are the entire agreement between you and the Company about the Services and replace all prior agreements and statements. A failure to enforce a provision is not a waiver of it. Section headings are for convenience only. “Including” means “including without limitation”.

(e) Assignment. You may not assign or transfer these Terms or your account without our written consent, except to a successor of your business who accepts these Terms. We may assign these Terms to an affiliate or to a successor of the Services.

(f) Electronic communications. You agree to receive communications from us electronically — inside the program, at the e-mail on your account or by SMS to the number you gave — and that electronic notices, agreements and signatures have the same effect as paper ones.

(g) Force majeure. Neither party is liable for a failure caused by events beyond its reasonable control, including outages of hosting, payment or messaging providers, internet failures, acts of government, natural disasters or labour disputes.

(h) Language. These Terms are published in English, Russian and Spanish. In case of any difference, the English version controls, except where the law of your country requires otherwise.

(i) Contact. Questions and complaints about the Services: support@kaizerbooking.com, or by post to Kaizer Inc., Attn: Legal, New York, NY, USA (registered address is provided on request). Do not include card numbers or other confidential information in e-mail.

(a) Возраст.

(a) Тарифы.

(a) Принадлежность.

(a) Право собственности.

(a) Повторные нарушители.

(a) Охватываемые претензии.

(a) Применимое право.

(i) Контакты.

1. Requisitos y cuentas

(a) Edad.

2. Suscripción, prueba y pago

(a) Planes.

(a) Propiedad.

(b) Licencia a nuestro favor.

7. Propiedad intelectual

(a) Titularidad.

8. Reclamaciones por derechos de autor

(a) Infractores reincidentes.

§ 512(c)(3) a nuestro agente designado:

(a) Reclamaciones cubiertas.

(g) Renuncia a acciones colectivas.

15. Disposiciones generales

(a) Ley aplicable.

(i) Contacto.
