The key points
Who is responsible
The salon is the seller
The salon sets the price, the terms and what is included, accepts the payment into its own account (see Payments and deposits) and must honour what it sold. Questions about a card, package or membership go to the salon.
What the salon must do
Gift cards
- show the terms before the purchase;
- no expiry date earlier than the law allows — at least 5 years under federal law, and in New York at least 9 years from the date of issue;
- no dormancy, inactivity or service fees where the law forbids them (it does in New York);
- let the holder check the balance.
Prepaid packages
Before payment, show what is included, how long the package is valid, whether it can be shared, and what happens to unused visits if the client stops coming — the refund must follow the salon’s stated rules and the law.
Memberships that renew
Under New York’s automatic renewal law (General Business Law §527-a) and federal rules, before the first charge the salon must clearly show: the price, how often it is charged, that the membership renews until cancelled, and how to cancel. The client must actively agree (for example by ticking a box), receive a confirmation with the cancellation terms, and be able to cancel online as easily as they signed up. Price changes are announced before they apply.
Refunds and disputes
Refunds are made by the salon under its stated rules and the law; card disputes are handled as described in Payments and deposits.
